Acordam na 1ª Secção do Tribunal Constitucional:

Nos autos de recurso de constitucionalidade interpostos nos termos da alínea a) do nº 1 do art. 70º da Lei do Tribunal Constitucional em que é recorrente o MINISTÉRIO PÚBLICO e recorrido A. que tem por objecto o despacho do Senhor Juiz do 2º juízo do Tribunal Judicial de Penafiel que desaplicou com fundamento em inconstitucionalidade o disposto no art. 6º do Decreto-Lei nº 404/93 de 10 de Dezembro com fundamento na sua inconstitucionalidade material e orgânica num caso em que se frustrara a notificação postal do casal requerido B. e mulher decide o Tribunal Constitucional conceder provimento ao recurso com base na fundamentação acolhida no Acórdão nº 375/95 ainda inédito e de que se juntou cópia aos autos e em consequência revogar o mesmo despacho o qual deverá ser reformado em concordância com o juízo de não inconstitucionalidade ali perfilhado.
