Constitutional challenge dismissed due to subsequent amnesty law rendering the challenged norm irrelevant.
Legislator summary
AI generatedThe Constitutional Court declared the unconstitutionality challenge inadmissible because the alleged violation was subsequently pardoned by a new amnesty law. The Ministry of Public Prosecution sought to challenge Article 27 of a 1989 decree, while the defendant argued its unconstitutionality. The court ruled that since the offense was already forgiven, the constitutional question became moot and unnecessary to decide.
