The Constitutional Court declared the challenged tax provision unconstitutional due to a violation of the creditor's right to satisfaction and the principle of proportionality. The Ministry of Public Prosecution appealed a lower court decision, arguing the law infringed upon fundamental constitutional guarantees. Consequently, the court rejected the appeal and nullified the legal basis that restricted creditors' claims.
