The Constitutional Court declared a specific provision of the Decree-Laws unconstitutional, ruling that it violated the constitutional rights to legal aid and judicial protection. The Ministry of Public Prosecution challenged the law, which denied judicial assistance to foreign asylum seekers who failed to obtain refugee status and lacked valid residence permits. The court held that excluding these individuals from legal aid without exception contravened the constitutional guarantees of effective judicial defense.
