Acordam no Tribunal Constitucional:

Nos presentes autos, vindos do Tribunal da Relação de Lisboa, sendo recorrente o Ministério Público e recorridos C... e J..., pelos fundamentos do acórdão nº 204/94 [D.R., II Série, de 19-7-1994], decide-se:

a) - Julgar inconstitucional a norma do artigo 3º, nº 1, alínea b), do Decreto-Lei nº 49 400, de 24 de Novembro de 1969, quando conjugada com os artigos 1º e 2º do mesmo diploma e por referência aos arti­gos 1º, 3º e 5º do Decreto-Lei nº 44 427, de 29 de Junho de 1962, aos artigos 4º e 6º do Decreto nº 44 428, de 29 de Junho de 1962 e ao artigo 1º do Decreto Regulamentar nº 45/78, de 23 de Novembro (na parte em que aditou um novo nº 1 ao artigo 10º do Decreto nº 44 428), por violação dos artigos 44º e 18º da Constituição da República.

b) - Negar provimento ao recurso e confirmar a decisão recor­rida.
