Portuguese Constitutional Court dismisses unconstitutionality claim due to subsequent amnesties of the alleged offense.
Legislator summary
AI generatedThe Tribunal Constitucional declared the unconstitutionality claim inadmissible because the underlying offense had been amnestied by a prior judicial decision. The recorrente challenged Articles 26 and 31 of Law 30/86, but the Tribunal da Relação de Coimbra had already determined the offense was amnestied under Article 1 of Law 15/94. Consequently, the court ruled the constitutional review unnecessary and extinguished the appeal without further analysis of the statutes' validity.
