The Constitutional Court declared Article 10(4) of Decree-Law 317/85 unconstitutional for granting local courts jurisdiction over immigration appeals. The Ministry of Public Prosecution challenged this provision, arguing it violated the constitutional principle of separation of powers by allowing judicial interference in administrative matters. The court ruled that such jurisdiction infringes upon the exclusive competence of the administrative branch, thereby negating the appeal's provision.
