The Constitutional Court declared Article 3(2) of the Expropriation Code unconstitutional because it failed to mandate compensation for servitudes affecting the remaining part of a building. The Ministry of Public Prosecution challenged the provision, arguing it violated property rights by denying compensation when the remaining land had prior building aptitude. The court ruled the law unconstitutional and consequently dismissed the appeal against the lower court's application of the statute.
