The Constitutional Court declared the specific compensation clause in the Expropriation Code unconstitutional due to its violation of constitutional property rights. The Ministry of Public Prosecution challenged the norm, arguing it failed to provide adequate indemnification for easements derived directly from law when the remaining land portion retained building aptitude prior to expropriation. The court ruled that the clause was invalid because it did not allow for compensation in these specific scenarios, thereby confirming the lower court's decision to reject the appeal.
