The Constitutional Court declared the appeal against the unconstitutionality of a municipal fine limit inadmissible because the underlying disciplinary offense was already resolved by a subsequent amnesty law. The Police Court had previously ruled that Article 82 of the Municipal Ordinance violated the Constitution by setting minimum fines above the statutory limit, but the Ministry of Public Prosecution argued the norm was valid. The Court determined that since the amnesty law definitively settled the specific case, any constitutional ruling would have no practical effect, leading to the extinction of the appeal.

Proc. nº 831/93 ACÓRDÃO Nº 52/95

1ª Secção

Rel. Cons.: Assunção Esteves

Acordam no Tribunal Constitucional:
