Constitutional appeal dismissed due to supervening extinction of the underlying labor dispute via settlement. The court ruled the constitutional review was unnecessary as the parties had already terminated their common action. The court held that constitutional appeals require a live legal controversy, which was extinguished by the parties' settlement agreement. Consequently, the appeal was declared inadmissible because the subject matter no longer existed. The decision emphasizes that procedural extinction precludes constitutional review. This case establishes that settled disputes cannot be subject to constitutional challenge.
Legislator summary
AI generatedThe Constitutional Court declared the constitutional appeal inadmissible due to the supervening extinction of the underlying lawsuit. The parties had previously settled their individual labor contract dispute, resulting in a homologated settlement agreement that terminated the common summary action. The court ruled that since the legal controversy no longer existed, the constitutional review was rendered useless and unnecessary. Therefore, the appeal was dismissed without examining the merits of the constitutional complaint.
