Constitutional challenge dismissed due to prior amnesty making the constitutional question moot.
Legislator summary
AI generatedThe Constitutional Court declared the constitutional appeal inadmissible because the underlying offense had already been pardoned by a prior amnesty law. The appellant challenged Article 10 of a 1991 Decree-Law, but the Tribunal de Relação of Lisbon had previously ruled that the specific contravention was amnestied under Article 1 of Law 15/94. Consequently, the court found the constitutional question superfluous and extinguished the recourse without further analysis.
Legislator headnote
AI generatedArticle 1 of Law 15/94; Article 10 of Decree-Law 17/91: When a specific offense is amnestied by a prior legislative act, any subsequent constitutional challenge to the norm imposing that offense is rendered moot and must be declared inadmissible.
