Constitutional challenge dismissed due to subsequent amnesty law rendering the challenged norm irrelevant.
Legislator summary
AI generatedThe Constitutional Court declared the constitutional challenge inadmissible because a subsequent amnesty law had already annulled the specific administrative violation. The Ministry of Public Prosecution sought to invalidate Article 27 of a 1989 Decree-Law, while the respondent had previously been granted amnesty for the offense under a 1994 law. The court ruled that the challenge was unnecessary since the legal basis for the violation no longer existed.
