Constitutional challenge dismissed due to subsequent amnesty making the norm's unconstitutionality moot.
Legislator summary
AI generatedThe Constitutional Court declared the unconstitutionality challenge moot and extinguished the proceedings. The Ministry of Public Prosecution argued the norm violated rights, but the lower court had already granted amnesty to the defendant under Article 1(f) of Law 15/94. The court ruled that since the penalty was nullified, the question of the law's unconstitutionality became irrelevant and the appeal was therefore useless.
Legislator headnote
AI generatedArticle 1(f) of Law 15/94; Article 27 of Decree-Law 30/89: When a subsequent amnesty renders a penal sanction null and void, a constitutional challenge to the underlying norm becomes moot and must be dismissed as useless.
