The Constitutional Court declared Article 33(1) of the Expropriation Code unconstitutional, ruling that capping compensation at 15% of construction costs violates constitutional property rights. The Ministry Public challenged a lower court decision upholding this cap against A. and his wife. The court held that such a rigid limitation fails to provide adequate compensation for land in urban agglomerations, thereby infringing upon the fundamental right to property.
