Acordam na 1ª Secção do Tribunal Constitucional:

Nos presentes autos de recurso, em que é recorrente o Ministério Público e é recorrido A., pelas razões constantes da exposição do relator de fls. 21 e 22 - razões que mereceram acolhimento do recorrente - decide o Tribunal Constitucional conceder provimento ao recurso, devendo o despacho recorrido ser reformado de harmonia com o julgamento em matéria de constitucionalidade.
