The Constitutional Court declared Articles 2 and 5(2) of Decree-Law 20-A/90 unconstitutional as they prevented the application of more favorable laws to fiscal offenses. The Ministry of Public Prosecution challenged the Supreme Administrative Court's ruling, arguing the new laws should not override existing regulations. The court ruled that such restrictions violate the constitutional principle requiring the application of the most favorable law to the accused.
