The Portuguese Constitutional Court declared Articles 2 and 5, Section 2 of Decree-Law 20-A/90 unconstitutional due to a violation of Article 29, Section 4 of the Constitution. The Ministry of Public Prosecution challenged the regime that reclassified certain fiscal offenses as minor infractions, arguing it hindered the application of more favorable laws. The court ruled that the legislative intent to treat these acts as minor infractions violated the principle of due process, thereby invalidating the specific norms while upholding the original lower court judgment on the constitutional question.
