The Constitutional Court declared Articles 2 and 5(2) of Decree-Law 20-A/90 unconstitutional for violating the principle of favorability. The Ministry of Public Prosecution challenged the Supreme Administrative Court's ruling that these fiscal contravention laws could not apply more favorable new regulations to offenses previously classified as contraventions. The court ruled that interpreting the laws to block the application of more lenient new legislation breached Article 29(4) of the Constitution.
