The Constitutional Court declared Articles 2 and 5(2) of Decree-Law 20-A/90 unconstitutional for prohibiting the application of more favorable laws to fiscal infractions. The Ministry of Public Prosecution argued that the new law should not apply retroactively to offenses previously classified as minor violations. The Court ruled that such a restriction violates the constitutional principle requiring the application of the most favorable law to the accused.
