The Constitutional Court declared specific articles of the Fiscal Offenses Decree-Law unconstitutional for violating the principle of favorability. The Ministry of Public Prosecution challenged a lower court ruling that applied a newer, more lenient law to a case previously classified as a minor offense. The court ruled that the old law could not be applied if it resulted in harsher penalties than the new law, thereby invalidating the lower court's confirmation of the prosecution's appeal.

Art. 29(4) of the Constitution; Art. 2 and 5(2) of Decree-Law 20-A/90: The principle of favorability requires that when a new law is more lenient than the old one, the new law must apply to all cases, rendering the application of the stricter old law unconstitutional.
