The Tribunal Constitucional denied the Public Prosecutor's appeal against a lower court ruling that found specific deportation provisions unconstitutional. The court held that Articles 2 and 5, number 2, of Decree-Law 20-A/90 violated fundamental rights by allowing deportation without sufficient safeguards for asylum seekers. Consequently, the court confirmed the lower court's decision to invalidate these norms, effectively blocking the deportation order.
