The Constitutional Court declared the relevant articles of the Fiscal Non-Duty Infringement Law unconstitutional due to their violation of the principle of favorableness. The Ministry of Public Prosecution challenged the law's interpretation that downgraded certain offenses to minor infractions, arguing it should not apply more favorable new regulations. The court ruled that the legislation failed to respect the constitutional requirement that new laws must not be less favorable than previous ones for the accused.
