The Portuguese Constitutional Court declared specific administrative penalty laws unconstitutional for violating the principle that new, more favorable laws apply retroactively. The Ministry of Public Prosecution challenged the interpretation of these laws which prevented their application to infractions previously classified as minor offenses. The court ruled that such interpretations violate the Constitution by blocking the application of newer, more lenient legislation to past violations.
