Portuguese Constitutional Court declares fiscal non-duty regulations unconstitutional for blocking more favorable new laws.
Legislator summary
AI generatedThe Tribunal Constitucional declared specific fiscal regulations unconstitutional for violating the principle that new laws apply even if they are more favorable to the taxpayer. The Ministry of Public Prosecution challenged the Supreme Administrative Court's decision upholding these rules, which prevented the application of newer, more lenient fiscal laws to certain infractions. The court ruled that such regulations contravene Article 29(4) of the Constitution by failing to allow the benefit of the new law.
