The Constitutional Court declared specific provisions of the Fiscal Non-Custodial Offenses Decree-Law unconstitutional for violating the principle of favoring the accused. The Ministry of Public Prosecution challenged the Supreme Administrative Court's ruling that applied a newer, more lenient law to offenses previously classified as non-custodial. The Court ruled that the old law's provisions preventing the application of the newer, more favorable law were invalid under Article 29(4) of the Constitution.
