The Constitutional Court denied the Public Prosecutor's appeal, ruling that specific articles of the 1990 Decree-Law on deportation are unconstitutional. The court found these provisions violated fundamental rights by allowing deportation without adequate procedural safeguards or consideration of family ties. Consequently, the lower court's judgment upholding the deportation order was confirmed as legally invalid.
