Constitutional Court declares administrative penalty laws unconstitutional for violating due process rights.
Legislator summary
AI generatedThe Constitutional Court declared Articles 2 and 5(2) of Decree-Law 20-A/90 unconstitutional for violating Article 29(4) of the Constitution. The Ministry of Public Prosecution challenged the lower court's judgment, arguing these laws improperly prevented the application of more favorable new regulations to infractions classified as contraventions. The court ruled that the legislative framework failed to guarantee the right to a fair trial and due process, thereby invalidating the specific provisions in question.
