The Constitutional Court declared Articles 2 and 5, Section 2 of Decree-Law 20-A/90 unconstitutional for violating Article 29, Section 4 of the Constitution. The Ministry of Public Prosecution challenged the lower court's judgment, arguing the laws improperly prevented the application of more favorable new legislation to infractions reclassified as administrative penalties. The Court ruled that the statutory interpretation violated constitutional due process guarantees, thereby dismissing the appeal and confirming the lower court's constitutional review outcome.
