The Constitutional Court declared Articles 2 and 5(2) of Decree-Law 20-A/90 unconstitutional for violating the principle that new laws apply retroactively to administrative offenses. The Ministry of Public Prosecution argued these articles prevented the application of a newer, more favorable law to past infractions. The Court ruled that such provisions contravened Article 29(4) of the Constitution by failing to allow the benefit of the new legislation.
