Constitutional Court declares administrative penalty laws unconstitutional for blocking more favorable new laws.
Legislator summary
AI generatedThe Constitutional Court declared specific articles of a Decree-Law unconstitutional for violating the principle that new laws apply even if they are more favorable to the offender. The Ministry of Public Prosecution challenged the lower court's judgment, arguing the Decree-Law should block the application of newer, more lenient regulations. The court ruled that such a restriction violates the constitutional mandate to apply the most favorable law, thereby invalidating the Decree-Law's intent to prevent the new law's application.
