The Constitutional Court declared Articles 2 and 5(2) of Decree-Law 20-A/90 unconstitutional for violating the principle that new laws apply even if they are more favorable. The Ministry of Public Prosecution challenged the lower court's refusal to apply a newer, more lenient law to administrative offenses previously defined by the older decree. The court ruled that the old laws could not be interpreted to block the application of newer, more favorable legislation, thereby invalidating the specific provisions in question.
