Portuguese Constitutional Court declares fiscal offense regulations unconstitutional for violating the principle of favorability. The court ruled that new laws must apply even if they downgrade offenses to minor infractions. This decision upholds the constitutional requirement that criminal liability cannot increase under new laws. The court confirmed the lower court's judgment on unconstitutionality. The ruling ensures that taxpayers benefit from more lenient legal interpretations. This case establishes the supremacy of the principle of favorability in Portuguese fiscal law.
