The Constitutional Court declared Article 2 of the Fiscal Offenses Decree-Law unconstitutional for violating the constitutional principle of favoring the taxpayer. The Ministry of Public Prosecution challenged the law's validity, arguing it improperly classified offenses as minor infractions. The court ruled that the legislation must be interpreted to allow the application of more favorable laws to the taxpayer, thereby invalidating the specific provision.
