The Constitutional Court dismissed the applicant's request to declare the non-existence of a prior ruling that found them to be a litigant in bad faith. The applicant argued that their status as a creditor and receipt of judicial assistance made the finding of bad faith arbitrary and unconstitutional. The court held that mere disagreement with a decision does not constitute legal nullity and that the applicant's creditor status is irrelevant to the assessment of bad faith. Consequently, the request was rejected, and the applicant was condemned to pay the incidental costs.

296/05
Constitutional complaint dismissed for failing to clearly raise the specific constitutional issue in the prior appeal. The court ruled that vague references to previous arguments do not constitute a valid preliminary question of constitutionality. The claim was rejected because the constitutional question was not sufficiently articulated and linked to the current proceedings. The court emphasized the procedural requirement for clarity in raising constitutional issues. The decision upheld the lower court's refusal to examine the constitutional complaint. The ruling reinforces the strict standard for admissibility of constitutional challenges. The court found the applicant's arguments insufficiently specific and disconnected from the current case. The judgment clarifies that prior judicial decisions do not automatically trigger constitutional review. The applicant failed to meet the threshold for a preliminary question of constitutionality. The court dismissed the complaint due to lack of clear and perceptible formulation. The decision highlights the importance of precise legal argumentation in constitutional proceedings.

Acórdão 584/93

ACÓRDÃO Nº 584/93

Processo nº 194-A/90

1ª Secção

Rel. Cons.

4.- Depois e normalmente, porque beneficio de concedida Assist. Jud., com dispensa de prévio pagamento, só a final e caso então eu possa, se me pode exigir o pagamento de custas;

4a. Dec. nº 562/70, de 18.11, artºs. 9º, a), e 29º; e Assento STJ, de 6.1.1988, in BMJ. 373º-138.

15º, 1, I, 16º, 17º, 2, 24º, 1, a), e 54º.

8a CRP, artºs. 1º a 3º, 8º, 9º, b), 13º, 16º a 20º, 29º, 1 e 3, 205º, 2, 206º, 207º, 272º, 2 e 3, e 288º, d); DUDH, artºs. 10º a 12º; PDCP, artºs. 14º, 1, I E II, 15º, 1, 16º e 17º; CEDH, artºs. 6º, 1, I, 7º, 1, I; e C.P.C., artºs. 201º, 668º, 1, d), I.

TERMOS EM QUE, E NOS MAIS DE DIREITO DOUTAMENTE SUPRÍVEIS, PEÇO E VªAS EXAS DEVEM:

a) DECLARAR/SANAR A SOBREDITAMENTE ARGUIDA (NULIDADE-)INEXISTÊNCIA JURÍDICA;

b) QUE LOGO - IMEDIATAMENTE DEPOIS - SE SIGAM OS DEMAIS E ULTERIORES TERMOS LEGAIS."
