The Constitutional Court of Portugal rejected the challenge to Article 11(1)(a) of Decree-Law 454/91, which limits public access to court records. The Ministry of Public Prosecution argued that the restriction was necessary to protect judicial efficiency and privacy, while the applicants claimed it violated constitutional rights. The court ruled that the measure was proportionate and did not infringe upon fundamental freedoms, thereby confirming the lower court's decision.
