Legislator summary

AI generated

The Constitutional Court upheld the constitutionality of the property damage requirement in civil liability law while granting the public prosecutor's appeal to revoke the lower court's decision. The case involved a challenge to Article 11(1)(a) of Decree-Law 454/91, which mandated proof of financial loss for certain torts. The court determined that requiring material prejudice does not violate constitutional rights and is a valid legislative condition for civil liability. Consequently, the lower court's ruling was overturned to align with this constitutional interpretation.
