Acordam na 2.ª Secção do Tribunal Constitucional:

Nestes autos, em que é recorrente o MINISTÉRIO PÚ­BLICO e arguido A., tendo por objecto a questão da inconstitucionalidade da norma do artigo 11.º, n.º 1, alínea a), do Decreto-Lei n.º 454/91, de 28 de Dezem­bro,

- pelos fundamentos do acórdão n.º 349/93, tirado em plenário e publicado no Diário da República, II Série, de 3 de Agosto de 1993, que aqui se dão por reproduzidos,

- decide-se:

(a). não julgar inconstitucional a norma do artigo 11.º, n.º 1, alínea a), do Decreto-Lei n.º 454/91, de 28 de De­zembro;

(b). conceder provimento ao recurso e, em conse­quência, revogar o acórdão recorrido, a fim de ser reformado de acordo com o aqui decidido no tocante ao julgamento da questão de inconstitucionalidade.
