PROCESSO Nº 6/93
Acordam na 2ª Secção do Tribunal Constitucional:
Nestes autos, em que é recorrente o MINISTÉRIO PÚBLICO e arguida A., tendo por objecto a questão da inconstitucionalidade da norma do artigo 11º, nº 1, alínea a), do Decreto-Lei nº 454/91, de 28 de Dezembro,-
- pelos fundamentos do Acórdão nº 349/93, tirado em plenário e publicado no Diário da República, II série, de 3 de Agosto de 1993, que aqui se dão por reproduzidos,-
- decide-se:
(a). não julgar inconstitucional a norma do artigo 11º, nº 1, alínea a), do Decreto-Lei nº 454/91, de 28 de Dezembro;
(b). conceder provimento ao recurso e, em consequência, revogar o acórdão recorrido, a fim de ser reformado de acordo com o aqui decidido no tocante ao julgamento da questão de inconstitucionalidade.
