The Constitutional Court granted the public prosecutor's appeal and revoked the lower court's ruling on unconstitutionality. The court relied on the foundational grounds of a previous decision (Acórdão nº 393/89) to justify overturning the original judgment. Consequently, the lower court was ordered to re-examine the unconstitutionality claim using the established legal reasoning from the cited precedent.
