Acordam na 2ª Secção do Tribunal Constitucional:

Nestes autos, em que é recorrente a empresa A., EP e recorrido B., tendo por objecto a questão da inconstitucionalidade da alínea ii) do artigo 1º da Lei nº 23/91, de 4 de Julho,

- pelos fundamentos do acórdão nº 152/93, publicado no Diário da República, II Série, de 16 de Março de 1993

- decide-se negar provimento ao recurso e confirmar a decisão recorrida quanto ao julgamento da questão de constitucionalidade.
