The Constitutional Court refused to declare unconstitutional the specific tax provision while ordering the lower court to reform its decision. The Ministry of Public Prosecution challenged the law's constitutionality, arguing it violated legal principles, but the Court found no such defect. Consequently, the Court declared the lower court's ruling invalid and mandated a new judgment consistent with the upheld statute.
