The Tribunal Constitucional declared Article 9(1) of Decree-Law 154/91 constitutional, rejecting the Public Ministry's challenge regarding public access to court records. The court reasoned that the law's restrictions on accessing case files do not violate the principle of public access to justice when balanced against the need for judicial efficiency and privacy. Consequently, the challenged decision was reformulated to uphold the statutory limitation on record access.
