The Constitutional Court refused to declare the tax provision unconstitutional and ordered the lower court to reform its ruling. The Ministry of Public Prosecution challenged the tax law's constitutionality, arguing it violated legal principles, while the company A. Lda. supported the challenge. The court determined the norm did not infringe constitutional rights and thus revoked the lower court's decision of invalidity.
