Legislator summary

AI generated

The Constitutional Court rejected the applicant's request to declare the prior judgment null and non-existent. Although the applicant expressed disagreement with the substantive outcome, they failed to invoke specific procedural grounds for nullity as required by the Civil Procedure Code. The court ruled that mere dissent without formal procedural defects does not justify setting aside a final decision.

ACÓRDÃO Nº 165/91

Processo n.º 24/89

2ª Secção.

Relator: Conselheiro Alves Correia

Acordam na 2ª Secção do Tribunal Constitucional:

O Dr. A., advogado, veio arguir no requerimento de fls.403 a 406 a nulidade / inexistência do Acórdão deste Tribunal n.º 317/90 (cfr. fls. 385 a 400).
