AI generated

The Constitutional Court rejected the Ministry of Public Prosecution's appeal regarding the mandatory application of a previously declared unconstitutional labor regulation. The court confirmed the lower tribunal's refusal to apply Article 3(b) of Portaria n.º 760/85, which had been invalidated by a prior ruling. Consequently, the decision was upheld, establishing that the obligation to apply the norm persists despite its constitutional unconstitutionality.
