Constitutional court dismisses appeal after declaring a specific administrative norm unconstitutional by general force. The court rejects the request to apply the norm because it has been declared unconstitutional. The procedural outcome is the denial of the appeal due to the prior general declaration of unconstitutionality. The court ruled that the norm cannot be applied because it was already declared unconstitutional with general binding force. The decision confirms that once a norm is declared unconstitutional, it loses its validity and cannot be applied in any case. The appeal is dismissed because the underlying norm is no longer valid law. The court's reasoning relies on the principle of general binding force of constitutional declarations. The outcome is a dismissal of the appeal against the judge's refusal to apply the invalid norm.

The Constitutional Court dismissed the appeal filed by the Public Prosecutor against a lower court's refusal to apply a specific administrative norm. The lower court had declined to apply Article 3(b) of Portaria 760/85, which the Constitutional Court had previously declared unconstitutional with general binding force in a prior decision. Consequently, the Court denied the appeal, ruling that the norm could not be applied due to its prior invalidation. The decision establishes that once a norm is declared unconstitutional with general binding force, it loses all legal validity and cannot be invoked in any proceedings.
