Legislator summary

AI generated

The Constitutional Court denied the Public Prosecutor's appeal against a lower court's refusal to apply a specific administrative norm. Although the lower court had initially declined to apply Article 3(b) of Portaria n.º 760/85, the Constitutional Court had already declared that same norm unconstitutional in a prior ruling. Consequently, the court confirmed the lower court's decision by applying the earlier declaration of unconstitutionality to reject the appeal.
