Acordam no Tribunal Constitucional:

Nos presentes autos de recurso de constitucionalidade em que é recorrente o Ministério Público e recorrido A., residente na Rua …, n.º … – …, Porto, julga-se válida, em conformidade com o disposto no artigo 681.º do Código de Processo Civil, analogicamente aplicável, a desistência do recurso constante de do documento de fls. 16.
