Constitutional appeal dismissed as criminal proceedings were already extinguished by amnesty law.
Legislator summary
AI generatedThe Constitutional Court declared the appeal extinct because the underlying criminal proceedings against the defendant had already been terminated by the application of the Amnesty Law. The defendant was charged with smuggling, but a judicial court had previously declared the criminal procedure extinguished due to amnesty, rendering the amnesty law applicable. Consequently, the court found the constitutional appeal devoid of any practical utility and dismissed it without further analysis.

ACÓRDÃO N.º 301/86
Processo n.º 177/86
